Forestry

As the appeal of forestry grows we have a dedicated team to work with our clients on all aspects of their forestry ventures.

At Tavendale and Partners we pride ourselves on having an unrivalled understanding of our country's primary industries. Many of our team come from a rural or agribusiness background. With this personal understanding of the unique challenges that face the agricultural industry, combined with our legal expertise, our team have unique and valuable skills beneficial to our clients.

We have strong relationships and work regularly with forest owners, forestry consultants, regulators and accountants to assist our clients with their forestry projects.

  • Structuring

Advising on and establishing appropriate structures for forestry ventures, from working with private clients on realising opportunities for their existing farms to the establishment of multiparty joint ventures.

  • Sales and Purchases

We support our clients from start to finish on both sales and purchases of forestry blocks, providing advice on all aspects of the transaction including due diligence, transfer of Emissions Trading Scheme arrangements and financing.

  • Forestry Rights

Drafting, negotiating, advising on and registering forestry rights under the Forestry Rights Registration Act 1983 (including for the claiming of carbon through the Emissions Trading Scheme).

  • Commercial contracts

Advising on a full range of commercial contracts including forest management services agreements, carbon management services agreements and harvesting contracts.

  • Legislative compliance

Compliance in the forestry space is complicated. Our team are well equipped to advise you on your compliance obligations whether that’s obligations and liabilities under the Climate Change Response Act 2002 or the resource consents you might need to harvest your forest.

  • Worksafe and Health & Safety

Forestry is a high risk area. In addition to our usual employment and health and safety practice, we can guide you through the Worksafe processes and act for you during any subsequent investigation or enforcement processes if something goes seriously wrong. Following a non-notifiable incident we can undertake or assist with an internal inquiry and/or policy review.

  • Emerging markets

Advising clients on participation in the voluntary carbon market, including negotiating carbon management agreements and sale agreements.
